1. Acceptance of Terms
By accessing and using 9Captcha's API and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by these terms, please do not use this service.
2. Service Description
9Captcha provides automated visual processing services via an API. We aim for high availability and rapid processing speeds for registered users with sufficient balance.
- You must deposit funds to use the API.
- Balances are non-refundable except in cases of prolonged service outage.
- We reserve the right to modify service speeds and pricing based on network load.
3. Prohibited Use
You agree not to use 9Captcha for any fraudulent, malicious, or abusive activities. The API is strictly for automation of legitimate tasks. We actively monitor network requests and will permanently ban accounts found participating in:
- Bulk account creation or credential stuffing.
- Paywall circumvention.
- Any activity that violates the Terms of Service of a target third-party site.
- Fraud, DDoS attacks, or network abuse.
4. Target-Site Compliance & Neutrality
You represent and warrant that your use of the Service complies with the terms of service of any third-party site you interact with. 9Captcha operates solely as a neutral automation tool. We are not a party to your relationship with any third-party site. We make no representations or warranties that our Service will not be detected or blocked by third parties.
5. API Usage and Rate Limiting
Your API key is private and should not be shared. You are responsible for all charges incurred by your API key. We implement rate limiting to ensure fair usage across all enterprise and basic clients.
6. Payment Processing
All transactions are processed securely via NOWPayments. We do not store any sensitive financial data on our servers. By depositing funds, you agree to comply with the respective terms of our payment processors.
7. Indemnification
You agree to indemnify, defend, and hold harmless 9Captcha and its affiliates, directors, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including any target-site Terms of Service.
8. Limitation of Liability
In no event shall 9Captcha be liable for any indirect, incidental, special, consequential or punitive damages. Our total liability to you for any claims under these Terms shall not exceed the total amount of fees paid by you to us in the twelve (12) months preceding the claim.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.
10. Termination
We may terminate or suspend access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
